As of June 21, 2023, New York landlords are required by law to disclose flood risks to tenants in residential lease agreements. This new regulation aims to empower renters with crucial information to make informed decisions about their homes. Let's break down what this means for you.

What You Must Disclose:

  • Flood History: Landlords must disclose any history of flood damage to the leased premises that they are aware of. This includes events like heavy rainfall, coastal storms, tidal inundation, or river overflow.
  • FEMA Floodplain Designation: The lease agreement must specify whether the property, or any portion of it, is located within a designated floodplain according to the Federal Emergency Management Agency (FEMA) flood maps. There are two key zones to be aware of:
    • Special Flood Hazard Area (SFHA): Also known as the 100-year floodplain, this area has a 1% annual chance of experiencing a flood.
    • Moderate Flood Hazard Area (MFHA): Also known as the 500-year floodplain, this area has a 0.2% annual chance of experiencing a flood.

What This Means for Tenants:

Knowing a unit's flood risk allows tenants to make informed decisions. Here's what tenants can do:

  • Assess Your Risk: Understanding the flood history and floodplain designation helps you evaluate your potential vulnerability to flooding.
  • Consider Flood Insurance: Standard renters' insurance typically doesn't cover flood damage. The lease agreement will include a notice informing you about the availability and importance of flood insurance through the National Flood Insurance Program (NFIP). Consider purchasing additional coverage if necessary.
  • Prepare for Potential Flooding: If your lease indicates a flood risk, take steps to mitigate potential damage. This could involve elevating furniture, storing valuables on higher floors, and knowing where to find sandbags.
