Good Cause Eviction Rider Requirement For NYC Landlords

Effective August 18th, 2024, NYC landlords will have to provide a notice of Good Cause Eviction applicability/inapplicability to their tenants when they take certain actions, including:

  • New Lease or Renewal: Landlords must notify tenants of Good Cause Eviction applicability or inapplicability when offering a new lease or renewing an existing one.
  • Non-Renewal or Termination: Landlords must notify tenants of Good Cause Eviction applicability or inapplicability when notifying them that their lease will not be renewed or their tenancy is otherwise ending.
  • Rent Increase (Over 5%): Landlords must notify tenants of Good Cause Eviction applicability or inapplicability when increasing the rent by more than 5%.
  • Past-Due Rent (14-Day Demand): Landlords must attach a notice of Good Cause Eviction applicability or inapplicability to a 14-day rent demand for past-due rent.
  • Eviction Court Filing: Landlords must attach a notice of Good Cause Eviction applicability or inapplicability to a petition filed in court for an eviction case.

Additionally, the Good Cause Eviction notice must include the following:

  • Coverage: Indicate whether the tenant's home is covered by Good Cause Eviction.
  • Non-Coverage Reason: If the home is not covered, provide the reason for the exemption.
  • Eviction or Non-Renewal Reason: If the home is covered and the landlord is evicting, not renewing, or ending the tenancy, state the specific Good Cause reason for the action.
  • Rent Increase Reason: If the home is covered and the landlord is raising the rent above the local standard, explain the reason for the "unreasonable rent increase."

  • Lease Terms: The terms of the lease agreement should clearly outline the specific grounds for eviction and any applicable procedures.
